By accessing or using the FOP Approved Provider Bulletin (“APB”) and any and all components found within https://fop.net/officer-wellness/ (“Site”), any User agrees to comply with and be bound by these Terms and Conditions and any amendments published from time to time. These Terms governs the access to the APB and the Site. Any User who does not agree to the Terms or any amendments thereto may not continue to use the APB and/or the Site. Any use of the APB or the Site is void where prohibited by law and the right to access the APB and the Site is revoked in such jurisdictions. By using the APB or the Site, User represents and warrants that User has the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein. For purposes of these Terms and Conditions, a User shall include any law enforcement professional and their family members, whether related by consanguinity or affinity.
The National Officer Wellness Committee (“Committee”) reserves the right, at its sole discretion, to modify these Terms, the Wellness Services and the various components of the Wellness Services at any time and without prior notice. If the National Fraternal Order of Police (“NFOP”) modifies these Terms, it will be indicated at the top of these Terms. Any User continuing to access or use the APB or Site after a posted modification indicates his or her agreement to the modified Terms. If the modified Terms are not acceptable to the User, the User shall immediately cease using the Wellness Services and its various components, including the APB and all elements found in the Site.
Disclaimer of Medical Liability. The Wellness Services and its various components as contained within the Site, including but not limited to the APB, are offered for informational, educational and scheduling purposes only, and are not intended to be a substitute for medical advice, diagnosis or treatment. The National Officer Wellness Committee does not provide therapy, medical advice, or medical or diagnostic services.
The National Officer Wellness Committee solely offers a nationwide directory of culturally competent wellness resources, all vetted by the Committee. This includes individual clinicians to inpatient treatment programs to wellness products and training geared toward law enforcement. It is the responsibility of the User to determine use or non-use of the APB. The Committee does not employ and is not responsible for the care provided by the program provider, professionals, paraprofessionals, staff or employees rendering service (“Service Provider”). The Committee shall not be responsible for any act or omission of any Service Provider or User.
The Service Providers are solely responsible for their interactions with each other and the Users. The Committee shall not be responsible for any and all claims, injuries, illnesses, damages, liabilities and costs (“Claims”) suffered by any User as a result of any interaction with or visit to any Service Provider. All Users agree not to impose or attempt to impose any liability or seek any legal remedy from the Committee with respect to any and all such Claims. The Committee cannot and does not control the content provided by the Service Provider with respect to its credentials, programming and other information upon which a User may rely for choosing a certain Service Provider. The Committee is not responsible for and disclaims any and all liability related to any and all services obtained from any and all Service Provider. All services obtained by any User will be made at such User’s own risk. Nothing stated or posted is intended to be, and must not be taken to be, the practice of medicine or the provision of medical care.
Any information provided within the Site is not intended for diagnosis. Users should disregard any care or drug treatment advice that may be believed to be delivered herein.
Users who are thinking about suicide or considering taking actions that may cause harm to the User or others, or if User feels that he or she or any other person may be in danger, or if User has any medical emergency, USER MUST IMMEDIATELY CALL 911 AND NOTIFY RELEVANT AUTHORITIES. USER ACKNOWLEDGES AND CONFIRMS THAT THE SITE IS NOT DESIGNED FOR USE IN INSTANCES OF SERIOUS MENTAL CONDITION DIAGNOSIS OR DRUG TREATMENT.
No Doctor/Patient Relationship. No licensed medical professional-patient relationship is created by using information provided by or through the Committee herein.
Termination. The Committee may suspend or terminate any User’s ability to use all or any element of the Site or may terminate these Terms effective immediately, without notice or explanation, in its sole discretion. Without limiting the foregoing, the Committee may suspend any User’s access if the Committee believes, in good faith, that the User is in violation of any part of these Terms.
Limitation of Liability. To the maximum extent permitted by law, in no event shall the Committee be liable for any injuries, losses, claims, or direct damages, or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, and even if advised of the possibility of such damages, which arise out of or are in any way connected with (a) these Terms, (b) any use of the Site or the services, (c) any failure or delay (including, but not limited to, the use or inability to use any component of the services, (d) use of any services by a Service Provider or non-performance or conduct by said Service Provider, or (e) termination by the Committee of User access. The Committee is neither an agent of nor otherwise associated with any Service Provider.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to certain Users. If any User is dissatisfied with any portion of delivery of services by any Service Provider or with these Terms, the User’s sole and exclusive remedy is to discontinue the use of services of the Service Provider.
Notwithstanding anything in the foregoing to the contrary, the Committee’s total cumulative liability to any User shall not exceed $100 for any and all claims relating to or arising out of the use of the Site, regardless of the form of action.
Governing law and Jurisdiction. All matters relating to the Site and the delivery of the services by the Service Providers and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the internal laws of the State of Ohio without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of, or related to the Site or the delivery of services by the Service Providers, shall be instituted exclusively in federal courts of the United States or the courts of the State of Ohio, Franklin County. User waives any and all objections to the exercise of jurisdiction and venue in such courts.
